House Speaker Greg Stumbo introduced HB 361, an act relating to Medicaid managed care organization provider payments on Monday. HB361 permits an enrollee of a medicaid managed care organization (MCO) to assign rights to appeal an action by an MCO relating to care received by an enrollee. The bill will establish an enrollee's right to a state fair hearing when an enrollee or assignee appeals an MCO's action relating to care received or proposed to be given to an enrollee. It will require an action by an MCO to state the reason for an action with specificity and states that the MCO shall pay for services rendered while an appeal was pending if a hearing officer reverses a decision to deny, reduce, or terminate health care services.
Rep. Stone introduced HB 362, an act relating to out of network benefits offered by a health benefit plan, on Monday. The bill requires an insurer offering a health benefit plan with out-of-network benefits to not limit the network to health care providers performing services or treatment within the Commonwealth of Kentucky. HB 362 also requires a health benefit plan with out-of-network benefits to not limit covered services to services or treatment provided within the Commonwealth of Kentucky.

Total revenue for the General Fund last month was $831.2 million, compared to $838.6 million during January 2013. The General Fund pays for most state programs. Receipts have grown 0.9 percent for the first seven months of this fiscal year, which began July 1. The official revenue estimate for the year calls for 2.1 percent growth in the General Fund.
