Day Twenty-One of KY's 2014 Session In Review

Speaker Greg Stumbo introduced on Wednesday HB335, an act relating to the Kentucky False Claims. The bill establishes provisions with enhanced civil liability and penalties for committing fraud against the state allowing the Attorney General or private citizens to sue on behalf of the state to recover damages, with some of the proceeds of the action being distributed to the person successfully bringing the action. The legislation will grant the Attorney General enhanced investigatory authority and provide an administrative sanctioning system for fraudulent Medicaid providers. It will provide civil protections for fraud whistleblowers and uniformity for allowable civil penalties and recovery mechanisms among other similar statutes. The bill is co-sponsored by the chairman of the Judiciary Committee John Tilley.

The Kentucky Senate passed a bill on Wednesday that would change the informed consent process required prior to abortion procedures. SB 8, sponsored by Senator Westerfield would add an ultrasound to the informed consent requirement for abortions performed in Kentucky.  The bill would require physicians to verbally describe the ultrasound images.  The woman could choose not to look at the images. The bill was approved 33-5 and will now go to the House of Representatives for consideration.

A bill that seeks to create a missed appointment fee pilot program for Medicaid patients was approved today by the Senate Health and Welfare Committee. SB 52, sponsored by Senator Denton would require the state to seek a waiver from Medicaid to start a pilot program in Jefferson, Letcher and Pike counties permitting health care providers to charge a $10 missed appointment fee.
